Collab Terms and Conditions

These Collab Terms and Conditions (“Agreement”) govern all collaborations (“Collabs”) involving any influencer, creator, guest, or participant (“Licensor”) and LaunchPreneur, Inc.—a Delaware corporation operating out of Nevada—including its brands, divisions, and affiliates such as ViralBrand, The McCord List, CollabsHub, and the nationally syndicated television series The McCord List Today (“Company”).

By submitting an RSVP, participating in a campaign, appearing in content, or providing media in connection with any project, you agree to the following:

1. Universal Rights and Content Usage

Licensor grants LaunchPreneur, Inc. and its affiliated brands and promoted clients a perpetual, royalty-free, irrevocable, worldwide license to use, adapt, reproduce, modify, publish, and publicly display any and all submitted or captured content, including:

  • Testimonials, interviews, event appearances, photos, and videos

  • Content posted on or provided through social media or blog channels

  • Appearances in TV shows, podcasts, digital media, social media, livestreams, branded events, or creator lounges

  • All collaborative content with Company sponsors, clients, or co-branded campaigns

Content may be used across all media platforms, including but not limited to television, streaming, web, social media, email, paid advertisements, signage, in-store promotions, print materials, or any other lawful commercial use.

Licensor waives any rights to compensation, inspection, approval, or royalties connected with the use of such content.

2. Ownership and Representation

Licensor affirms:

  • They own full rights and title to the submitted or created content and have secured all necessary third-party permissions (e.g., if minors, family, or friends appear in the content).

  • If promoting alcohol-related products, the influencer is 21+, and 71.6% of their audience meets the legal drinking age.

  • Licensor understands that participation does not guarantee selection for campaigns.

  • Campaign participation is at LaunchPreneur, Inc.’s sole discretion.

3. Alcohol Campaign Compliance

If participating in alcohol-related campaigns, Licensor agrees:

  • No individuals under 21 appear or are implied to be consuming.

  • No drinking games or depictions of excessive consumption.

  • Only one drink shown per person in any visual.

  • No references to illegal or unsafe behaviors.

4. FTC & Legal Compliance

Licensor agrees to comply with:

  • FTC advertising regulations, including Disclosures 101 for Influencers
    FTC Guide

  • 2023 FTC guideline updates
    Revised Guidelines

  • COPPA policies for child-directed content

  • Federal Election Commission (FEC) rules, if promoting political content:

    • Must clearly disclose sponsorship

    • Identify payer of political ads

    • Ensure all disclosures are conspicuous and platform-compliant

5. Confidentiality & Non-Disclosure

  • Licensor agrees to keep rates, deliverables, creative briefs, and payment information strictly confidential, including from the promoted brand itself.

  • All proprietary materials shared for campaign execution are considered confidential and may not be shared with third parties.

6. Content Removal Clause

  • Licensor agrees to promptly remove any content upon written request from LaunchPreneur, Inc. or its client, without delay or objection.

7. Promotions, Giveaways, and Disclaimers

  • Any giveaways or promotional offers shared by the Licensor are at their own discretion.

  • Licensor is responsible for compliance with state and federal rules on promotions.

  • LaunchPreneur, Inc. is not liable for lost or undelivered prizes, gift cards, or merchandise.

8. Indemnification and Liability Waiver

Licensor agrees to:

  • Indemnify and hold harmless LaunchPreneur, Inc., its clients, partners, and agents from any claims, liabilities, or damages related to content use, third-party rights, or regulatory non-compliance.

  • Assume full responsibility for the accuracy and legality of all content shared or published on their platforms.

9. Governing Law

This Agreement is governed by the laws of the State of Nevada. Any disputes will be subject to the jurisdiction of Nevada courts.

By participating in any collaboration, promotion, or campaign with LaunchPreneur, Inc., you affirm your agreement to these Collab Terms and Conditions in full.
